We confirm that any personal details which you provide to us (or which are available on public registers) from which we can identify you are held in accordance with our Data Protection Registration Notification. When you place an order on the Allswage UK Online Store Website, we consider the information you input as private. The information is kept on a secure server protected from outside parties. Messages should be addressed to sales@allswageuk.co.uk with the subject “Remove Me from Your List” on the e-mail you send confirming the registered details to be removed.

You should be aware that if we are requested by the police or any regulatory or government authority investigating suspected illegal activities to provide your User Information and/or information concerning your activities whilst using the Allswage UK Website we shall do so.

We aim to keep our records as current as possible and you may change or update our records at any time by e-mailing our Customer Service Representative or making the change on the Allswage UK Online Store Website.

You have a right to request a copy of any information we hold on you for which we will charge a small fee, and to correct any inaccuracies.

Indemnity

Purchase of Products

Orders

All orders are subject to acceptance in accordance with our Order Acknowledgement Policy and availability. If the Product you have ordered is not available from stock you will still be able to place an order on the Allswage UK Online Store Website. If an order is accepted for which there is no current stock you will be contacted by e-mail and will have the option either to wait until the item is available from stock or to cancel your order in accordance with our Cancellation Policy. We will, however, make sure to send your order to you as soon as possible.

We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Allswage UK Online Store Website.

Order Acknowledgement Policy

Your order will only be accepted, and a legally binding contract entered in between us on despatch of the Product to you.

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Allswage UK reserves the right at any time after receipt of your order to accept or decline your order for any reason. Allswage UK reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. All orders placed over £5000.00 (Inc. Vat) must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance department. We may require additional verifications or information before accepting any order.

The contract between you and us will be completed on the despatch of the Products ordered to you unless we have notified you that we do not accept your order, or you have cancelled it in accordance with our Cancellation Policy.
The sale contract is therefore completed in England.
We reserve the right to reject any offer to purchase by you at any time.

Once you submit an order, we immediately prepare all stock items for delivery. You can cancel your order at any stage until delivery. If you would like to request the cancellation of an order, please provide:

Customer name
Order number
Date of your order
The Product Code and Quantity of the item you would like to cancel.

Delivery

Please ensure there is a person available at the delivery address on the day of delivery to sign for the goods. Failure to this will result in the goods being returned to the local carrier depot and additional charges may be incurred to re-deliver the goods.

Does not Work?

Allswage UK stands by the high quality of all our Products. Each Product will have been tested and inspected by an authorised engineer prior to delivery. If in the unlikely event of a product failure, please follow our returns procedure in the section below. If the product failure is found to be as a result of operator error Allswage UK reserves the right to charge the customer for collecting the goods and any parts and labour required to return the product back to working order.

In the unlikely event of a problem all Products are sold with the full manufacturer’s warranty. The warranty period and service vary by Product.

Returns Procedure

Product returns will only be authorised after the end user has confirmed that all operating manuals and instructions have been carefully read and adhered to. Product returns must be authorised with Allswage UK 14 days from goods receipt, failure to do so will result in the goods being refused return. All returns must be received back at Allswage UK within 14 days of authorisation and must be in excellent condition and unused.

Through contacting sales@allswageuk.co.uk or calling 0121 553 5048 Allswage UK reserve the right to a partial refund if the goods are not in perfect condition on return. All items must be returned in ‘as-new’ condition, in the original packaging and with all warranty cards, manuals and accessories. Failure to return goods in this condition will affect the value of the refund. All returns will be subject to a minimum 15% re-stocking fee.

All products being returned to Allswage UK must be empty of all fluids such as fuel, oil, water, etc

**Please Note – If the products are found not to be defective, the customer may be liable for any additional shipping costs incurred.**

Description of Products

All details, descriptions and prices of Products appearing on the Allswage UK Online Store Website are correct at the time when the relevant information was inputted. Although we aim to keep the Allswage UK Online Store Website as up to date as possible, the information appearing on the Allswage UK Online Store Website at a particular time may not always reflect the position exactly at the moment you place an order.

Payment

All prices are correct at the time of entering information. You will receive an electronic confirmation of our receipt of your order via e-mail. Payment can be made by any of the specified Payment Methods. Payment will be debited and cleared from your account at the despatch of your Product.

You confirm that the credit/debit card that is being used is yours.

All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.

Refusal of Transaction

We reserve the right to withdraw any Products from the Allswage UK Online Store Website at any time and/or remove, screen, or edit any materials or content on the Allswage UK Online Store Website. We may refuse to process a transaction for any reason or refuse service to anyone at any time in our sole discretion.

We will not be liable to you or any third party by reason of our withdrawing any Product from the Allswage UK Online Store Website whether or not that Product has been sold; removing, screening, or editing any materials or content on the Allswage UK Online Store Website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

Waiver

No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.

Survival

Entire Agreement

Law

The Conditions shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.
